Welcome to the terms of use of European Judicial Training Network (“EJTN”, “us”, “our”), a not-for-profit Association with its registered office at Rue du Commerce 123, 1000 Brussels, Belgium.
Please read these Terms and Conditions (T&C) carefully, as they set forth the general terms and conditions of your use of the website and any of its related services, including but not limited to membership and all it entails. This agreement is legally binding between you and EJTN. By accessing and using the website and its services, you acknowledge that you have read, understood, and agree to be bound by the terms of this agreement. You acknowledge that this agreement is a contract between you and EJTN, even though it is electronic and not physically signed by you, and it governs your use of the website and its services.
PURPOSE AND USE
EJTN is devoid of any profit motive and has as its aim the promotion of training programmes with a genuine European dimension for members of the European judiciary and for court staff. EJTN exclusively and directly pursues objectives of a non-profit making character. In particular, EJTN establishes an annual programme of activities promoted among its members and others invited to participate.
MEMBERSHIP
EJTN is built on a membership-system, by which membership is available to all national institutions of the Member States of the European Union specifically responsible for the training of the professional judiciary and for the training of prosecutors (where they form part of the “corps judiciaire”). These institutions will be called “members” in these T&C. One can become a member by applying for it to EJTN’s General Assembly. Please note: These T&C apply not only to your use of this website, but also if you are a member and if you participate in EJTN’s training programmes and activities.
PERSONAL DATA AND PRIVACY
In order to benefit from EJTN’s annual training programme and activities, EJTN will be required to process personal information of the people participating therein (“participants”). Participants will be brought forward by their members, after which participants will sign up to the programmes and activities provided by EJTN as part of the registration process. Participants will then be able to provide their accurate, complete, and updated personal data on the website. Each registration is for a single user only. For the dissemination of participants’ lists, pictures, and recordings, EJTN has opted to use legitimate interest as a legal ground instead of consent, and subsequently has carried out the necessary Legitimate Interest Assessment to justify it. Please notify EJTN at dpo@ejtn.eu of any known or suspected unauthorized use(s) of your registration data, or any known or suspected breaches of security, including loss, theft, or unauthorized disclosure of personal information.
AGE REQUIREMENT
You must at least be 18 years of age to use the website and its services. By using the website and its services and by agreeing to these T&C you warrant and represent that you are at least 18 years old.
LINKS TO OTHER RESOURCES
Although this website and its services may link to other resources (such as websites), we are not, directly, or indirectly, implying any approval, association, sponsorship, endorsement, or affiliation with any linked resource, unless specifically stated therein. We do not assume any responsibility or liability for the actions, products, services, and content of any other third parties.
PROHIBITED USES
In addition to other terms as set forth in these T&C, you are prohibited from using the website and its services or content:
a) For any unlawful purpose;
b) To solicit others to perform or participate in any unlawful acts;
c) To violate any international, federal, provincial, or state regulations, rules, laws or local ordinance;
d) To infringe upon or violate our intellectual property rights or the intellectual property rights of others;
e) To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
f) To submit false or misleading information
g) To upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the website and its services;
h) To spam, phish, pharm, pretext, spider, crawl, or scrape;
i) For any obscene or immoral purpose;
j) To interfere with or circumvent the security features of the website and its services. We reserve the right to terminate your use of the website and its services for violating any of the prohibited uses.
INTELLECTUAL PROPERTY RIGHTS
All intellectual property rights, title and interest vested in EJTN are either our property or have been licenced to us by third parties. These T&C do not transfer to you any intellectual property owned by EJTN or third parties, and all rights, titles, and interests in and to such property will remain solely with EJTN. All trademarks, service marks, graphics and logos used in connection with the website and its services, are trademarks or registered trademarks of EJTN or its licensors. Other trademarks, service marks, graphic and logos used in connection with the website and its services may be the trademarks of other third parties. Neither your participation to EJTN training programmes or activities, or you use of the website and its services grants you the right or license to reproduce or otherwise use any of the EJTN or third-party trademarks.
THIRD PARTY CONTENT
Our website may contain hyperlinks and URLS from various sources, including but not limited to our members. This type of third-party content may link to a third-party digital environment: we have no control over the content of those environments, websites or resources, and therefore cannot accept responsibility for third party sites or any loss or damage that may arise from your use of such third-party sites. You acknowledge and agree that your right to use such third-party content may be subject to additional terms and conditions and privacy policies of the third-parties providing these services, and you do so entirely at your own risk, and you will not hold EJTN liable for any loss or damage that may arise. If you do not agree to these additional conditions, you should not use third party content or third-party sites.
If any third-party obtains or collects personal data or other information from you, in no event shall we assume or have any responsibility or liability for such collection or related processing activity, to the extent permitted by applicable law and regulations. Any other concerns regarding third-party content should be directed to the appropriate site.
INDEMNIFICATION
To the extent permitted by applicable legislation, you agree to indemnify and hold EJTN and its affiliates, officers, directors, employees, and experts harmless from and against any liabilities, losses, damages, or costs, including but not limited to attorneys’ fees, arising from any of the following conditions:
Your violation of any of these T&C;
Your violation of any third party right; or
Any wilful misconduct on your part.
LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, in no event will EJTN, its affiliates, directors, officers, , employees, or experts be liable to any person of any direct, indirect, incidental, special, punitive, cover or consequential damages (including, without limitation, damages for lost profits, goodwill, use of content, impact on business) however caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise, even if the liable party has been advised as to the possibility of such damages or could have foreseen such damages.
DISPUTE RESOLUTION
The formation, interpretation, and performance of these T&C and any disputes arising out of it shall be governed by the substantive and procedural laws of Belgium, without regards to its rules on conflicts or choice of law, and to the extent applicable, the laws of Belgium. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the courts located in Belgium.
CHANGES AND AMENDMENTS
We reserve the right to modify these T&C at any time at our discretion. When we do, we will revise the updated date at the bottom of this page and post a notification on the main page of the website. We may also provide a notice to you in other ways at our discretion, such as via an email or other contact information you have provided.
An updated version of these T&C will be effective immediately upon the posting of the revised T&C unless otherwise specified.
ACCEPTANCE OF THESE TERMS
You acknowledge that you have read these T&C and agree to them. By either becoming a member or by accessing and using the website and its services, you agree to abide by all of the T&C between you and EJTN. If you do not agree to abide by these terms, you should not apply for membership and are not authorised to access or use the website and its services.
